The sound of a siren, sight of flashing lights, and then, being issued a traffic citation. What to do? What are my options? How much will my car insurance premiums increase?
You may pay the ticket, but you will incur the points that accompany the specific citation on your driving record. You may see an increase in your car insurance premiums.
You may fight the ticket on your own by requesting an informal hearing. At the court hearing, you will be able to cross examine the police officer who issued you the traffic citation, testify on your own behalf as well as call witnesses to testify. At the conclusion of the hearing, the magistrate will make his/her decision as to whether you are responsible for the allegations contained in the traffic citation. If found responsible, you will be assessed a fine and incur the points that accompany the specific citation on your driving record.
You may retain counsel. If so, you do not need to take time off of work to appear for the hearing as the attorney will appear for you.

EXPUNGEMENTS – SETTING ASIDE PRIOR CRIMINAL CONVICTIONS OR JUVENILE ADJUDICATIONS

Effective April 11, 2021, Michigan expanded the types and number of criminal matters that may be set aside. A person may petition the court where a prior criminal conviction occurred seeking to set aside the conviction. MCL 780.621. A person may also seek to set aside more than one criminal conviction. If a person’s criminal convictions occurred in different courts, a person would need to file a separate petition to set aside the conviction in each court.
After a criminal conviction is set aside, most employers will not be able to access such with a criminal background check. The Michigan state police will keep a non-public record of the criminal conviction that was set aside. The non-public record can be accessed under limited circumstances by certain governmental agencies.
